Lahore High Court: The order declaring the promotion of Hakeem in grade 16 as illegal is null and void

The Lahore High Court annulled the order declaring Hakeem's upgradation in grade 16 illegal.

Justice Tariq Saleem Sheikh delivered the verdict on Hakeem Mohammad Ayub's petition against the Health Department.

The written judgment said that the Director General (DG) Health Services had declared illegal the upgradation of Hakims to Grade 16 in November 2018. The promotion of Hakims from Grade 15 to 16 was made in the light of the Finance Department's 2016 notification. In 2018, DG Health issued an order not to apply the notification to Hakims.

Muhammad Ayub filed a review petition before the department which was not decided. On applying for retirement and pension in January 2021, Ayub was asked to account for the money taken for development.

Ayub was asked to return Grade 16 salaries from January 2016 to January 2021.
The court declared in the judgment that what the petitioner took with the permission of the competent authorities cannot be taken back. The court ordered the petitioner's pension papers to be processed within 60 days.
